Terms & Conditions
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions
2. Entry is limited to NSW Residents who are Optus Small Business customers aged 18 years or over (“Entrants”). Employees (and their immediate families) and agencies associated with this promotion are ineligible to enter.
3. To be eligible to enter, individuals must, during the promotional period visit dralionhoops.com.au or escapeforaday.com.au, follow the prompts to the registration page, input the requested details and then submit the fully completed registration form. Only one entry per customer.
4. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrants' identity, age, place of residence) and to disqualify any Entrant that submits an entry that is not in accordance with the Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Incomplete or indecipherable entries will be deemed invalid.
6. By submitting an entry, each Entrant warrants that they are over 18 years of age.
7. Promotion commences on Thursday 29th May at 9:00am (Sydney Time). Final entries close on Monday 30th June at 11:59pm (Sydney Time). Entries not received by that time and date or not completed in accordance with these Terms and Conditions will not be eligible to win.
8. The draw will take place at Optus, 1 Lyonpark Rd, Macquarie Park, NSW, 2113 on Friday 4th July at 11:00am (AEST) and five (5) winners will be drawn. Winners will be notified via email and/or by telephone. The Promoter's decision is final and no correspondence will be entered into.
9. The first five (5) valid entries drawn will win two (2) tickets to The 'Behind the Scenes Experience Program' to Cirque du Soleil Dralion on the 9th August 2008 at 1.30pm (Sydney Time) at the Show Ring, Entertainment Quarter, Lang Road, Moore Park, NSW, 2021. It comprises of (a) 1:45pm: Site Tour which includes visit of the concession tents, the artistic tent, the Grand Chapiteau, and the backstage area; (b) 2:15pm; Meal in the Artist's Kitchen and Q&A with hosts; (c) 3.00pm Tapis Rouge Experience; (d) 4.00pm: Show – Dralion performance. The Dralion performance is approximately 2.5 hours and includes 30 minutes interval. The total duration of the 'Behind the Scene Program' including Dralion performance is approximately 6 hours. Please note: The information outlined above is subject to change dependant on the time and date of Dralion Performances. Any additional costs associated with attending the prize, including, but not limited to, travel to and from the venue, are the responsibility of the winner. Each prize is valued at AUD$1,100. Prizes are not transferable or exchangeable and cannot be redeemed for cash.
10. If for any reason a winner does not take an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
11. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
12. Total prize value is AUD $5500.
13. If any of the prizes remain unclaimed by 11.00am (Sydney Time) on Friday 18th July 2008 an unclaimed prize draw will take place. The first valid entry drawn and successfully contacted by phone and in writing will win the prize. If the unclaimed prize draw winner cannot be contacted within 24 hours, this condition will apply to subsequent draws until a prize winner is determined. Results will be published in The Australian on Friday 25th July 2008.
14. Prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
16. All entries are deemed to be received at the time of receipt into the Promoter's database not at the time of transmission by the Entrant.
17. Any cost associated with accessing the promotional website is the Entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the prize event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or Entrant; or (g) attendance at the prize event.
19. Entrants consent to the Promoter using the Entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter and related bodies corporate may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the Entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
